EU BPA Rules for Vending Equipment: Which Transition Date Applies?

Separate repeat-use food-contact articles, professional production equipment and single-use packs before accepting a delivery date.

Is the relevant BPA deadline in 2026 or 2028?

Both dates appear in the EU rules, but they apply to different categories. For an equipment order, first identify the food-contact article and the basis for the supplier's proposed transition. A machine described as professional or commercial does not, by that description alone, establish that its food-contact articles qualify for the professional food production equipment provision.

This buying brief follows Regulation (EU) 2024/3190, read with Commission Regulation (EU) 2026/250. It addresses procurement questions about BPA transitions; it does not certify a WEIMI machine, establish that a particular part contains BPA, or determine the legal classification of your configuration.

Start with the article and its material

Article 1 covers specified groups of food-contact materials and articles placed on the Union market: adhesives, rubbers, ion-exchange resins, plastics, printing inks, silicones, and varnishes and coatings. Article 3 prohibits using BPA in their manufacture and placing articles manufactured using BPA on the Union market, subject to the regulation's specific derogations and transitional provisions.

Ask the supplier to identify the relevant finished article, its material and its intended food contact. Separate a repeat-use part in a food preparation path from a single-use pack sold through the machine. For a cabinet handling sealed goods, establish the actual contact scope rather than assuming that every shelf or housing is a food-contact article.

The existing food-contact parts document map explains how to connect component identity to the purchasing file. The additional question here is which BPA transition, if any, the identified article relies on.

Read the two repeat-use routes separately

Article 12 concerns repeat-use final food-contact articles manufactured using BPA that comply with the rules applicable before the regulation entered into force but do not comply with the new rules. Its dates are conditional transition provisions, not a general approval of any material sold before a deadline.

  • Article 12(1), general repeat-use route: qualifying articles may be first placed on the market until 20 July 2026. Under the corrected Article 12(3), articles first placed in accordance with that paragraph may remain on the market until 20 July 2027.
  • Article 12(2), professional food production equipment route: qualifying repeat-use final food-contact articles used as professional food production equipment may be first placed on the market until 20 January 2028. Under the corrected Article 12(3), articles first placed in accordance with that paragraph may remain on the market until 20 January 2029.

The 2026 correction matters. Recital 7 of Regulation (EU) 2026/250 explains that the additional period allows businesses to pass the articles on to customers. It expressly separates the 2027 date for the first route from the 2029 date for the professional equipment route.

Do not treat a quotation date as first market placement

A quotation, deposit, factory completion date, shipment date and customer delivery date are different commercial records. Do not choose one as the legal first-placement date without a reasoned assessment of the transaction. Ask the responsible supplier or importer to explain the relevant event, the article identified and the evidence supporting that date.

The later remain-on-market dates do not give every article a new first-placement deadline. They apply to articles first placed in accordance with the relevant paragraph. Nor should these supply-chain transition dates be converted into an operating lifetime or a mandatory disposal date for installed equipment without a separate assessment.

What should the supplier explain before you accept the equipment?

Request a written response tied to the configuration being quoted. Identify each relevant food-contact article by reference and version. Ask whether it complies with the new requirements or relies on a transition. If a transition is claimed, request the precise paragraph, evidence of compliance with the earlier rules, and the basis for the proposed first-placement and subsequent supply dates.

If the response relies on Article 12(2), ask why that article and intended use qualify as professional food production equipment. A machine that prepares a product and a cabinet that sells sealed packs present different facts for review. Do not resolve the question from the words vending machine, industrial, commercial or professional alone.

Article 8 requires covered articles not yet in contact with food, and the specified starting substances, to be accompanied at marketing stages other than retail by a written declaration of compliance. Annex III includes the issuer and manufacturer or importer identity and contact details, the identity of the relevant material or article, the declaration date, the bisphenols or derivatives used, and a compliance statement. Supporting documentation must be available to competent authorities on demand. Determine the information needed for your role rather than assuming a retailer receives every laboratory file.

Keep packaging on a separate decision path

Article 11 has its own rules for single-use final food-contact articles, including specified exceptions. Do not transfer the professional equipment deadline to cups, trays, lids or other single-use packs simply because they are supplied with a vending installation. The plastic packaging evidence guide addresses matching the commercial pack to its intended food, storage and heating use.

Likewise, a BPA-free statement does not resolve every requirement for food-contact suitability. The regulation also addresses other hazardous bisphenols and derivatives. Have the responsible materials reviewer assess the actual formulation, intended use and current applicable rules rather than treating a short marketing label as the complete evidence.

Turn an unresolved answer into a clear purchase condition

If the supplier cannot identify the article or explain the claimed transition, keep that point open in the order review. Ask for the missing scope answer before accepting a compliance claim. If a material or part is changed, request updated identification and documentation for the supplied version. This is a suggested purchasing workflow, not a report of a customer incident or an assurance that WEIMI offers an automatic document-checking function.

For an equipment discussion, provide the destination, whether food stays sealed or is prepared in the unit, and the intended food-contact workflow. Get My Custom Quote and ask for the quoted configuration and available component documentation to be identified for your reviewer.
